Copyright Policy

We respect the intellectual-property rights of others and expect our users to do the same. This Copyright Policy explains how to report content you believe infringes your copyright, and how we handle such reports. It covers both notices under the U.S. Digital Millennium Copyright Act ("DMCA") and notice-and-action requests under EU law, including Regulation (EU) 2022/2065 (the "DSA").

1. Our commitment

We do not permit content that infringes the copyright or other intellectual-property rights of any third party. We will respond to properly submitted notices by removing or disabling access to allegedly infringing content, and we terminate, in appropriate circumstances, the accounts of users who repeatedly infringe.

2. How to submit a copyright notice

If you are a rights holder (or authorised to act on one's behalf) and believe your work has been used on the Service without authorisation, send a written notice to our copyright contact:

Your notice must include:

your name, address, telephone number and email;
identification of the copyrighted work you claim has been infringed (or a representative list);
identification of the material you claim is infringing, with enough detail and the exact URL(s) for us to locate it;
a statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent, or the law;
a statement that the information in your notice is accurate and, under penalty of perjury, that you are the rights holder or authorised to act on the rights holder's behalf; and
your physical or electronic signature.

Incomplete notices may delay our response. Please note that under Section 512(f) of the DMCA and under applicable EU and Polish law, knowingly making a material misrepresentation that content is infringing may expose you to liability, including damages and costs.

3. What we do with a valid notice

Upon receiving a valid notice, we will act expeditiously to remove or disable access to the identified material, and we will make reasonable efforts to notify the affected user, providing a statement of reasons where required by the DSA. We may forward your notice, including your contact details, to the user who posted the material.

4. Counter-notification

If your content was removed and you believe this was a mistake or misidentification, or that you are authorised to use the material, you may send a counter-notification to dmca@vireliavault.com including:

your name, address, telephone number and email;
identification of the material that was removed and the location where it appeared before removal;
a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
your consent to the jurisdiction of the competent courts and your agreement to accept service of process from the party who filed the original notice; and
your physical or electronic signature.

Where the DMCA applies, if we receive a valid counter-notification we may restore the material in 10 to 14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

5. EU notice-and-action and illegal content

Independently of the DMCA process, any person can notify us of content they consider illegal (including copyright-infringing content) under the DSA and Polish law, using the in-service reporting tools or by writing to legal@vireliavault.com. We handle such notices in a timely, diligent, non-arbitrary and objective manner, and provide affected users with information about the decision and available redress, including the possibility of out-of-court dispute settlement and judicial remedies.

6. Repeat infringers

We maintain a policy of terminating, in appropriate circumstances and at our discretion, the accounts of users who are the subject of repeated valid infringement notices.

For complaints about trademarks, publicity/image rights, privacy, or other non-copyright matters, contact legal@vireliavault.com with a clear description of the right, the allegedly infringing material and its location, and the basis for your complaint.
